Once you are aware that water has damaged your property, what you do next is critical. Most if not all insurance policies have a “Duties Clause”. The Duties Clause has a host of requirements for the policyholder. These are the expected duties or responsibilities of the policyholder. Failure to abide by these duties may result in your claim being denied.

The most important duty is the duty to mitigate against further damage. This means take action right away to stop the damage from becoming worse. Install a tarp on a leaking roof. Shut the water off when a leak is present. Involve the industry professionals sooner rather than later.

Hire a plumber to make repairs, a roofer to install a tarp, a water mitigation contractor to dry property that is wet. Whatever is required, it is very important that you make the effort to mitigate the damage.
